Pathé gift card terms

1. General

1.1 In these Pathé Gift Card terms and conditions, the following terms are given the following meanings:

• Cinema: A cinema operated by Pathé in the Netherlands.
• Pathé: Pathé Theaters B.V. and the Pathé group companies in the Netherlands.
• Pathé Gift Card: The Pathé Gift Card that can be used to pay at Cinemas, on the Website, in the Pathé App and at Pathé Thuis as further determined in these Terms and Conditions.
• Pathé App: Pathé's application for iOS and Android.
• Pathé Thuis: The video on demand platform of Pathé ThuisBioscoop B.V., accessible via www.pathe-thuis.nl.
• Conditions: These Pathé Gift Card Conditions.
• Website: The Pathé website, accessible via www.pathe.nl.

1.2 In addition to the Pathé Thuis Terms of Use (http://www.pathethuis.nl/documents/pathethuisvoorwaarden.pdf) and the Pathé Visitor Conditions (https://www.pathe.nl/en/info/pathe-visitor-terms), these Conditions apply to the use of Pathé Gift Cards issued by or on behalf of Pathé. By using the Pathé Gift Card you accept these Terms and Conditions and you undertake to comply with these Terms and Conditions.

 

2. Pathé Gift Card conditions

2.1 The Pathé Gift Card can be purchased at the cash register in cinemas and on the Website. If a Pathé Gift Card is purchased at the cash register of a cinema, a physical Pathé Gift Card will be issued. The physical Pathé Gift Card is available in different designs. When a Pathé Gift Card is purchased via the Website, the Pathé Gift Card will only be issued by e-mail. The Pathé Gift Card by e-mail is available in different designs. These designs can only be seen in the relevant email.

2.2 A credit can be placed on the Pathé Gift Card between €5 (five euros) and €150 (one hundred and fifty euros) per unit of €2.50 (two euros and fifty cents). You can view the current balance of a Pathé Gift Card at any time at www.pathe.nl/giftcard.

2.3 The Pathé Gift Card can be used to pay for expenses in the Cinema, in the Pathé App and on the Pathé Website, for example for the purchase of cinema tickets, refreshments, Pathé Events, Pathé Specials, 3D and IMAX surcharges. At Pathé Thuis, the Pathé Gift Card can only be used to pay for watching films.

2.4 For instructions on how to use the Pathé Gift Card, please visit www.pathe.nl/en/giftcard.

2.5 The Pathé Gift Card cannot be returned and/or exchanged for money, except in the case referred to in Article 3.

2.6 The credit on a Pathé Gift Card is valid for four years after the date of purchase. The Pathé Gift Card can no longer be used after the expiry date. You can view the validity period of a Pathé Gift Card at www.pathe.nl/en/giftcard. When the validity of (the credit on) a Gift Card has expired, no money will be refunded.

 

3. Right of withdrawal

3.1 You have the right to revoke the purchase of the Pathé Gift Card purchased via the Website without giving reasons within 14 (fourteen) days after the purchase was made, unless you have already used the gift card within that period. Pathé will deduct the amount you have spent with the Pathé Gift Card in the period prior to the cancellation from the amount you receive in return.

3.2 The right of withdrawal does not apply to Pathé Gift Cards purchased in a cinema.

3.3 The amount you receive will be refunded immediately and in any case no later than 14 (fourteen) days after we have been informed of your decision to withdraw from the agreement. We will reimburse you with the same payment method on the same account with which you made the original transaction, unless you have expressly agreed otherwise; in any case, you will not be charged any fees for such reimbursement.

3.4 You can revoke the purchase of a Pathé Gift Card by:

• contacting Pathé customer service in a timely manner;
• sending a completed cancellation form. 

 

4. Customer service

4.1 For questions or complaints about a Pathé Gift Card, please contact Pathé customer service. Pathé Customer Service is available Monday to Sunday from 9:00 AM to 11:00 PM. Customer service can be reached by telephone on 088 - 51 52 000 (usual calling costs). You can also contact Pathé via pathe.nl/nl/help.

 

5. General provisions

5.1 Pathé makes reasonable efforts to provide accurate and up-to-date information on the Website and on the Pathé Gift Card. However, all information shown is subject to so-called printing and typesetting errors.

5.2 Pathé may assume that the user of the Pathé Gift Card is also the rightful owner of the card. Pathé is not obliged to carry out further checks regarding the validity of (a) Pathé Gift Card(s).

5.3 Use of a Pathé Gift Card is only permitted in accordance with these Terms and Conditions. It is not permitted to copy or otherwise multiply and/or distribute a Pathé Gift Card.

5.4 If a user of a Pathé Gift Card misuses a Pathé Gift Card and/or commits fraud and/or attempts to commit fraud with a Pathé Gift Card, including (attempting to) watch films on Pathé Thuis by falsification of the code stated on the Pathé Gift Card, or by circumventing (technical) security measures in another way, Pathé will immediately prevent this user from using the facilities of the Cinema, the App, the Website and/ or Pathé Thuis and Pathé can block Pathé Gift Cards at its own discretion without any obligation to pay compensation. Pathé will report such behavior by a user to the judicial authorities and is furthermore fully entitled to recover its full damages from this user.

5.5 It is not permitted to use a Pathé Gift Card in any way for commercial purposes and/or purposes other than those for which it was issued, without prior written permission from Pathé.

5.6 Pathé reserves the right to make changes to these Terms and Conditions from time to time. You can consult the most current version of these conditions at any time at www.pathe.nl/en/giftcard.

5.7 Pathé's privacy statement applies to the use of personal data in the context of the Pathé Gift Card.
